J&S Custom Furniture Co. Limited Warranty

J&S Custom Furniture Co. warrants that the custom furniture, millwork and other products it manufactures will be free from defects in materials and workmanship for a period of one (1) year from the date of the final invoice, subject to the limitations and exceptions below.

For defects covered by this warranty, J&S Custom Furniture Co., at its sole discretion, will determine the appropriate remedy, which may include modification, adjustment, repair, replacement or addition to the affected product or component at no additional charge to the customer.

Any modification, adjustment, repair, replacement or other service under this warranty applies only where J&S Custom Furniture Co. determines that the condition results from a defect in materials, workmanship or installation covered by this warranty.

LIMITATIONS AND EXCEPTIONS

This warranty extends for one (1) year from the date of the final invoice and applies only to the original purchaser.

Any warranty provided by J&S Custom Furniture Co., whether express or implied, covers only normal use of its products in accordance with any product specifications, care instructions and maintenance requirements provided to the customer by J&S Custom Furniture Co.

This limited warranty does not apply to any condition or damage resulting from accident; acts of third persons; environmental or site conditions; misuse or abuse; normal wear and tear; delivery or transportation damage; improper storage; or modifications or alterations made by any person other than J&S Custom Furniture Co.

This warranty also does not apply to conditions resulting from incorrect or inadequate maintenance, cleaning or care, or damage caused by chemical treatments, cleaning products or protective coatings not recommended by J&S Custom Furniture Co. The application of such products may void warranty coverage for any resulting damage.

Environmental and site conditions include, without limitation, changes in temperature or humidity; seasonal movement; building settlement, shifting or structural movement; and movement or changes to walls, floors, ceilings, openings or other site conditions. Adjustments, realignment, modifications or service required as a result of these conditions are not considered defects in J&S Custom Furniture Co.’s materials, workmanship or installation and are not covered by this warranty.

Solid wood is a natural material that expands, contracts and otherwise responds to changes in temperature and humidity. Customers are responsible for maintaining appropriate environmental conditions and following the care and maintenance instructions provided by J&S Custom Furniture Co. Natural or seasonal wood movement is not, by itself, considered a defect in materials or workmanship.

The customer’s remedy under this limited warranty is limited to the remedy determined appropriate by J&S Custom Furniture Co. for the affected product or component. Any modification, adjustment, repair or replacement performed under this warranty does not extend or restart the original warranty period.

Warranty service will only be provided upon receipt by J&S Custom Furniture Co. of a valid written explanation of the claimed defect from the original customer within one (1) year of the final invoice date. J&S Custom Furniture Co. may require photographs, videos, measurements, proof of environmental conditions, an inspection of the product or installation, or other reasonable information necessary to assess the claim and determine whether it is covered by this warranty.

SIZE AND DIMENSION VARIABILITY

The sizes and dimensions of J&S Custom Furniture Co. designs may vary from the actual sizes and dimensions of delivered products due to the expansion and contraction of wood products, the inherent nature of the materials and the handmade nature of J&S Custom Furniture Co.’s products.

The customer assumes responsibility for confirming that the dimensions specified for an order are appropriate for the intended location and use. In no event shall a mistake in size or dimension resulting from customer-provided measurements, specifications or other customer error invalidate an order or require a refund to the customer.

APPEARANCE VARIABILITY

The customer acknowledges that the appearance of the wood used to build a particular product may vary from wood used in samples, photographs, displays or other products due to the natural characteristics of wood and the craftsmanship used to create each individual product.

Therefore, no representation, warranty or guarantee is made with respect to the exact colour, lustre, grain or appearance of the natural materials or finishes of any product.

The customer also acknowledges that wood used in J&S Custom Furniture Co. products may contain mineral deposits, pits, gum streaks, small pin holes, knots, checks, cracks, colour differences, unusual grain patterns, darker heartwood, lighter sapwood and other naturally occurring characteristics.

The frequency and appearance of these features depend upon the material specified and will vary between handmade and machined pieces. No two products produced by J&S Custom Furniture Co. are exact duplicates, and J&S Custom Furniture Co. therefore makes no representation or guarantee that one product will appear exactly the same as another product, sample or photograph.

DISCLAIMER

For greater certainty, J&S Custom Furniture Co. does not warrant:

  • Natural variations in wood grain or figure or the presence of character marks.
  • Natural expansion, contraction or seasonal movement of solid wood resulting from changes in environmental conditions.
  • Changes in surface finishes, including colourfastness, due to aging or exposure to light.
  • Marks, scars or wrinkles occurring naturally in leather.
  • Failure resulting from normal wear and tear.
  • Pilling of textiles.
  • The matching of colours, grains or textures of natural materials.
  • The colourfastness or matching of colours of textiles, including an exact match to cuttings, samples or swatch cards.
  • Damage, marking or staining of surfaces due to contact with rubber or similar compounds.
  • Damage caused by sharp objects, imprinting from writing instruments or prolonged exposure to direct sunlight.
  • Products or parts manufactured by third parties but sold or supplied by J&S Custom Furniture Co.
  • Soiling, stains or dye transfer from clothing, including denim.
  • Finishes applied by a third party.
  • Modifications, alterations, repairs or adjustments performed by a third party.
  • Any product identified as using reclaimed wood or barn wood, with respect to the inherent characteristics, prior wear, checking, cracking, nail or fastener holes, colour variation, weathering or other characteristics associated with reclaimed materials.
  • Foreign objects abrading fabric over time.
  • Products exposed to abnormal environmental conditions, including excessive heat, cold, moisture, dryness or humidity.
  • Damage, movement, misalignment or adjustment resulting from building settlement, structural movement or changes to walls, floors, ceilings, openings or other site conditions.
  • Products that have been subject to improper storage, care, maintenance or installation by parties other than J&S Custom Furniture Co.
  • Any construction, material, design, technique or workmanship specifically requested or specified by a customer that differs from J&S Custom Furniture Co.’s recommended design, material, construction or technique.

Except as expressly provided in this limited warranty and subject to any rights or remedies that cannot lawfully be excluded, no other warranty is made on behalf of J&S Custom Furniture Co. with respect to its products, their parts, or their operation, repair or replacement.

No representative, distributor or retailer of J&S Custom Furniture Co. is authorized to change or modify this limited warranty unless expressly authorized in writing by J&S Custom Furniture Co.

Some retailers may offer extended or additional warranties, including fabric warranties, either directly or through a third party. J&S Custom Furniture Co. is not responsible for warranties independently offered by a retailer or third party.

To the extent permitted by applicable law, J&S Custom Furniture Co. shall not be responsible for consequential or incidental damages, including loss of use or time, inconvenience, commercial loss or damage to personal property, whether direct or indirect and whether arising in contract or tort.

To the extent permitted by applicable law, J&S Custom Furniture Co.’s responsibility under this limited warranty shall not exceed the original purchase price of the affected product or its replacement.

REMEDY AND CLAIM PROCEDURE

Customers who believe they have a defect covered by this warranty must contact J&S Custom Furniture Co. by email or phone and provide the original invoice number, a description of the claimed defect and any photographs, videos, measurements or other information reasonably requested by J&S Custom Furniture Co. to assess the claim.

J&S Custom Furniture Co. reserves the right to inspect the product or installation and determine whether the claimed condition is covered by this limited warranty and, where coverage applies, to determine the appropriate remedy in accordance with the terms of this warranty.
